Introduction

This Notice applies to information we collect on our Website, in email, other electronic messages between you and NKA, information you provide to us, and information we collect when you use an online service through our Website, such as the NK University.  

This Notice does not apply to information collected by any third party, including through any application or content, including advertising, which may link to or be accessible from our Website, such as from Event links.  NKA is not responsible for the privacy practices or the content of those other websites.  This Notice also does not apply to information collected via NKA’s products and software.

Children Under the Age of 16.  Our Website is not intended for children under the age of 16. Information We Collect About You And How We Collect It

We collect information about you in many ways and some of the information we collect may include personal information that can be used to identify you.  Personal information does not include publicly available information from government records or deidentified or aggregated information.

Code §1798.80(e)), such as, for example, your real name, any alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, bank account number, credit card number, debit card number, or any other financial information to process an individual’s request for an online course or material, or other similar identifiers;

(4) Commercial information such as, for example, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies;

(6) Internet or other similar activity such as, for example, your browsing history, search history, and information regarding your interaction with our Website or applications;

(9) Professional or employment related information such as, for example, some of our forms may request your current employer and/or job title and if you submit an application through our “Careers” link (https://us.nihonkohden.com/careers/) we collect additional information in this category and our application includes our information collection practices; and

(11) Inferences drawn from other personal information such as, for example, your profile reflecting your preferences.

We do not collect information relating to (3) Protected Classification, (5) Biometric Information, (7) Geolocation Data using any process or technique to derive from a device your location, however we do collect your address as an Identifier, (8) Sensory Data, or (10) Non-public education information.

 

We obtain the categories of information from the following sources

Information you provide to us voluntarily.  In general, you can visit our Website without providing any information other than the information we collect automatically.  There are times, however, when we may need information from you.  You may choose to give us personal information in a variety of situations.  For example, we may collect your name, address, email address, telephone number, billing information, or other information you may provide when you contact us about our services, engage with our Website to register to use or use any of our services, when you submit a form, when you register for an event or for a course, when you request a paper or other information from us, or when you provide your contact information in your role as an employee when submitting applications for a Grant or Charitable Contribution.  If you contact us, we maintain records of your correspondence, including your name and address or email address.  

If you choose not to provide us with certain information, you may not be able to take advantage of certain features of our services.

Information we collect automatically.  As you navigate and interact with our Website, we may use automatic data collection technologies to collect certain information about you. For example, we use cookies to tell us about your device. Cookies are small pieces of information that are stored by your web browser on your computer's hard drive and allow us to serve you faster and with better quality.  Cookies tell us about your equipment, browsing actions, and patterns including details of your visits to our Website, and information about your computer and internet connection, including your IP address or device identifier, operating system, and browser type.  

We may also use these technologies to collect information about your online activities over time.  This helps us to improve our Website and services and deliver a more personalized experience by, for example, storing information about your preferences, allowing us to customize our Website according to interests, and to improve content, speed up searches, recognize you when you return to our Website, and/or compile reports and analyze how well our websites and services are performing.

We also use the third party marketing and analytical services provided by Google Analytics.  These services use cookies with a randomly-generated ClientID in your browser. This ID is anonymized.  IP anonymization is also activated on our Website, which shortens your IP Address.  We send Google this shortened your IP Address to understand how visitors interact with our Website, what webpages are accessed, how often, and for which period of time our pages viewed.  This analysis is used to optimize our Website.  The IP address transferred through your browser to Google Analytics will not be combined with other data held by Google.  You can manage the data collected by Google Analytics by deleting your(_ga)cookies, installing the Google Analytics Opt-Out Browser Add-On, or by contacting us (see Help below).

Our Website may contain links to other third-party websites, for example, when you access our Events link.  Some of these third parties may generate their own cookies. The third-party companies that generate these cookies may have their own policies and terms, including privacy policies. NKA is not responsible for the privacy policies or practices of third-party websites.

Information We Share

We may disclose aggregated information about users without restriction.  

NKA may share your personal information with other parties in the following instances:

  • With Our Third-Party Service Providers. NKA may share your information with our service providers who help us run our business and provide services on our behalf (for example, credit card processing services, managing our application process, providing materials or courses through NK University, providing marketing and analytical services, or building and providing our Applications). When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the service provider to keep the personal information confidential and not use it for any purpose except for performing the business purpose set forth in the contract.  
  • For Corporate Transactions. NKA may also disclose your information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of NKA’s assets, where personal information held by NKA about our Website users is among the assets transferred.
  • Other Reasons. To: (a) satisfy applicable law, regulations, legal process or valid governmental request; (b) enforce the terms of use applicable to our services, (c) detect, prevent or mitigate fraud or security or technical issues; or (d) protect against imminent harm to the rights, property or safety of our company, our customers or the public as required or permitted by law.

In the preceding twelve (12) months, NKA has disclosed the following categories of personal information for a business purpose: (1) Identifiers, (2) Personal Information as defined in Cal. Civ. Code 1798.80(e), (4) Commercial Information, (6) Internet or other similar activity, and (11) Inferences drawn from personal information.  

In the preceding twelve months, NKA has not sold personal information.  

Security

NKA respects your personal information and takes steps to protect it from loss, misuse, or alteration.  Where appropriate, these steps can include technical measures like firewalls, intrusion detection and prevention systems, unique and complex passwords, and encryption.  We also use administrative and physical measures such as training staff on data processing obligations, identification of data incidents and risks, restricting staff access to your personal information, and ensuring physical security including appropriately securing information when not being used.
